Privacy Policy


1.   This Privacy Policy (“Privacy Policy“) applies to the services of The Association for Construction and Infrastructure Law (Registered NPO), association no. 580740488, 121 Begin Road, Tel Aviv-Yafo 6701203 (the Association“). The Privacy Policy is intended for both women and men alike and is drafted in the masculine form for convenience only.

2.   Definitions – in this Privacy Policy:

2.1  Use of the Website” – use or attempted use of the website located at https://scl.org.il and/or the landing pages and/or any other digital platform of the Association.

2.2  Contacting the Association” – any inquiry to the Association not through the website, including by telephone, email, fax, physical approach, and the like.

2.3  User“, “You any person making use of the services as defined below, including anyone who uses the website and/or contacts the Association.

2.4  The Services” – all of the Association’s activities for users, including the publication of information regarding construction and infrastructure, assistance in collaborations between individuals and organizations, publication and marketing, direct mailing, registration for professional conferences, the provision of information about the Association’s activities, advice or other services, whether in the course of using the website or in the course of contacting the Association.

3.   By performing any action in the course of the services, you declare that you have read the Privacy Policy, understood its contents, and agreed to be bound by its provisions. If you do not agree to any provision of the Privacy Policy, you must immediately cease using the relevant services.

4.   The Association reserves the right to update the Privacy Policy from time to time, at its sole discretion and without the need for prior notice. The validity of a change to the Privacy Policy shall begin from the moment of its publication on the website and shall apply to anyone using the services. Notwithstanding the foregoing, if material changes are made to this policy, a notice thereof will be published on the website.

Provision of Information and the Consequences of Not Providing It

5.   The Association respects your privacy. In the course of the services, personal information about you will be collected, namely information that identifies or may enable your identification. Personal information is collected when you provide it to the Association in the course of using the website and/or receiving the services and/or when contacting the Association, as well as information that is collected automatically in the course of using the website by means of data collection technologies as detailed below.

6.   You are aware that there is no legal obligation to provide personal information, unless expressly stated otherwise (although it is clarified that with respect to security cameras, in some cases the Association is legally required to install them), however, failure to provide certain information or failure to provide full and complete information may prevent the Association from providing you with the requested services. Providing information (including by way of continued browsing or use of the various services) constitutes consent to its processing in accordance with the Privacy Policy. If you do not agree to the processing terms set forth here, you must cease all use of the services.

Types of Information, How It Is Collected, and Where It Is Stored

7.   The Association processes, inter alia, data regarding the content and information transmitted about you in the course of using the services and any information and/or data about you and/or others related to you (whether provided by you or by others).

8.   Personal information provided by you

8.1  The information collected may include, inter alia: personal details (name, address, telephone, email), contact details, the content of conversations and correspondence, business and financial information provided in the course of contacting the Association, and any other information provided in the course of the engagement with the Association. It is possible that inquiries to the Association will be retained and/or recorded for the purpose of monitoring and improving the service and for legal needs.

8.2  Contacting the Association through various channels – the information you provide when contacting the Association through any channel, including telephone number, email address, the content of the inquiry and correspondence, and files uploaded by you, is stored in the Association’s systems. In addition, conversations with the Association may be recorded for monitoring and service improvement purposes.

8.3  Purchases and making payments – in the course of making payments for membership in the Association, we collect personal details related to making the payment such as full name or business name, email address, ID number, and telephone number, and may also collect any additional information requested at the time of payment and marked as a mandatory field.

After completing the above details, you will be transferred to a secure payment page and will be asked to complete the details of the payment method with which you will make the payment, as well as your ID number. The Association does not retain the details required on the payment page, and the payment processing service is operated through the company “Green Invoice”, which will charge or credit the provided payment method, perform checks of the payment details, or transfer and/or obtain information about the user as required from time to time, all subject to the privacy policy, terms of use, and cancellation policy of “Green Invoice”.

9.   Personal information collected automatically – in addition, insofar as website use is concerned, the Association also collects personal information that is not collected directly from you, for example – information about the device and its use, IP address, usage analytics, crash and error reports, browser and device characteristics, information about operating system functionality, language preferences, website addresses, location, information about the manner and time in which you use the website and your use of the internet before and after such use, content preferences, other technical information and/or data that may not necessarily be related to you. You are aware that the Association may transfer statistical information about your activity on websites as stated to third parties, including advertisers. Statistical information transferred will not personally identify you. You consent to the aforesaid transfer.

 

Data Collection Technologies on the Website

It is possible that in the course of your use of the website and/or in the course of your use of the services, additional information will be collected by the Association and/or anyone on its behalf, automatically and/or from the context, including the time of the inquiry and its duration, and the manner of the inquiry, namely through which communication channel.

In addition, certain monitoring technologies may be used, such as cookies, pixels, tags, and scripts (hereinafter collectively: “Cookies“) embedded in the digital assets. These technologies collect and analyze data on how the digital assets are used for the purposes detailed below. Some of the Cookies are operated by us (“first-party Cookies”) and some are operated by external partners who provide us with data analytics, advertising, and marketing services (“third-party Cookies”), who may also use the information collected for the business purposes of those third parties.

You may delete and/or prevent the creation of Cookies on the device you use by changing the relevant settings in the browser through which you browse, except for essential Cookies, which cannot be disabled.   

Purposes of Information Collection and Use

10. The Association shall be entitled to process personal information about you for the purpose of carrying out activities related to the services as well as for its business operations. For example, the Association will process the information in order to:

10.1 To operate various services. For example, the Association uses details about you provided in the course of contacting it in order to respond to your inquiries, provide information about services as well as conferences and special events managed by the Association, manage relationships with existing and potential customers, resolve any potential problems you may have in the course of the services, and for the purpose of providing the services.

10.2 To improve the Association’s services.

10.3 For documentation and tracking of inquiries, requests, and the provision of services.

10.4 To enroll you as a member of the Association.

10.5 The Association uses information collected through data collection technologies in the course of website use for the purpose of operating and improving the website.

10.6 To enforce and/or protect the rights, property, and/or legal and/or other interests of the Association and/or of third parties, and to protect your safety and/or that of any person and/or other entity related to the Association.

10.7 In order to comply with, and assess compliance with, applicable laws, rules, regulations, judicial decisions, and internal policies and procedures.

10.8 To defend against legal claims, demands, and/or other legal proceedings.

10.9 For information security purposes. These purposes include conducting the analysis required to detect malicious data and understand how they may affect you, for the purpose of monitoring and statistically analyzing ongoing attacks on devices and systems, and for the ongoing adaptation of the solutions provided to secure devices and systems against various attacks.

 

Sharing Information About You with Third Parties

11. The Association works with various third parties from time to time and will transfer personal information about you to them, for example in cases where it seeks assistance for the purposes of processing the information detailed above, and for example in the following cases:

11.1 To answer your questions, fulfill your requests, and share knowledge on a particular subject.

11.2 When the Association finds that your actions in the course of using the services are carried out for the purpose of committing fraud of any kind, or that they are actions that appear to be contrary to law, or an attempt to perform such actions.

11.3 If the Association is required to do so pursuant to a legal demand and/or a judicial order and/or a demand by a competent authority instructing the Association to provide your details.

11.4 If the Association faces a threat that legal proceedings (criminal or civil) will be taken against it due to actions you performed in the services.

11.5 In the context of any dispute, claim, lawsuit, demand, or legal proceedings, if any, between you and the Association and/or in connection with the services.

11.6 To service providers (including outside Israel) engaged to perform services on behalf of the Association. It is clarified that the Association requires all service providers engaged to perform services on behalf of the Association to agree to process personal information about you in accordance with the Association’s privacy policy.

11.7 Information about you that will be transferred outside the jurisdiction of Israel, including to places where the laws relating to privacy and information security may not be as comprehensive as the laws in force in Israel, will be carried out in accordance with the Privacy Protection Regulations (Transfer of Information to Databases Outside the Borders of the State), 5761-2001.

11.8 In any case where the Association believes that providing personal information about you is necessary in order to prevent harm to its rights or those of third parties and/or to officials of the Association.

11.9 Within the framework of collaborations with companies that are business-related to the Association.

If the Association operates the services within another corporation – and likewise in the event that the Association merges with another entity or merges its activity with the activity of a third party, all in whole or in part – it will be entitled to transfer to the new corporation or to such third party the information collected about you in the database or any statistical information in its possession, provided that this corporation or third party undertakes the provisions of the Association’s privacy policy or provisions of the same nature.

12.  In addition, the Association may transfer information that does not personally identify you (for example, statistical or aggregated information), for consideration or without consideration, to third parties with whom it has business or other relationships, for any purpose.

 

Mailings and Advertisements

13. The Association may contact you (by itself or through anyone on its behalf) in response to a “Contact Us” request, in any form and by any means including by telephone or email or text messages or otherwise, and also send you any content (including marketing information by means of direct mailing as defined in the Privacy Protection Law and advertising material as defined in the Communications Law (Telecommunications and Broadcasts), 5742-1982 (“Direct Mailing and “Advertisements“, respectively) and/or invitations to events and/or conferences), even if you are registered in the “Do Not Call Me” registry or a similar registry.

14. If you do not wish to continue receiving direct mailings and advertisements as stated, or if you wish to be removed from the Association’s database (subject to the law and the Association’s policy), you may, at any time, revoke your consent as stated by sending a notice to the Association at the following email address: office@scl.org.il or as indicated in the notice you receive.

Third-Party Links

15. The website includes links to various third-party websites. The links on the website should not be seen as a recommendation to use them, and they are on the website for your convenience only. When you move to a third-party website, you are subject to that website’s privacy policy and terms of use, and therefore we recommend that you review them carefully and examine whether they suit your needs before browsing that website. The Association is not responsible for the content of the websites linked on the website, or for the quality of the service provided on them, and it will bear no responsibility whatsoever in connection with these websites.

Information Retention Period

16.  We retain personal information required by us for the purpose of providing the services, in order to support our ongoing business activity in accordance with the Association’s procedures and as required by law. In addition, we may continue to retain your personal information if there is a need to do so, for example, for possible preparation for a legal proceeding or for documentation and archiving purposes and other legal needs. Your personal information will be retained in an information database of the Association, which may also be held and managed for it by a third party.

Information security

17. The Association attaches great importance to safeguarding your privacy and makes commercially reasonable efforts under the circumstances in order to protect personal information about you that was provided to it by you. Notwithstanding the foregoing, while these measures reduce the risks of unauthorized intrusion into the Association’s computers, there is no absolute security or electronic storage method that is secured or protected 100%. The Association cannot undertake to you that unlawful intrusion into the website or its systems will not be possible. If you believe that the personal information about you may be exposed to unauthorized parties, you must notify the Association immediately by contacting it using the details below. The Association makes efforts that it considers reasonable to prevent unauthorized access to information collected as part of the services.

Minors

18. As a rule, the services are intended for users over the age of 18. To the extent that certain services are also intended for users under the age of 18, these users must obtain the consent of their parents or their legal guardian before using these services and providing personal details on the website. If you (or your parents or another guardian on your behalf) do not agree to the terms of use and/or to this privacy policy, all or part of them, you are requested to refrain from making any use of the website for any purpose whatsoever.

Right to Review and Request Correction

19.  In certain circumstances, you may have the right to review personal information collected about you in accordance with Section 13 of the Privacy Protection Law, and you may also have the right to request correction or deletion of information collected about you if you find that it is not correct, complete, clear, or up to date in accordance with Section 14 of the said law. Change to the Terms of This Privacy Policy

20.  The Association reserves the right to change the terms of this privacy policy from time to time and as needed at its sole discretion, without the need for prior notice. The Association reserves the right to inform you as a customer of changes that materially affect your rights, if made, by one of the means of communication provided by you, but notwithstanding the foregoing, if material changes are made to this policy, a notice thereof will be published on the website. Your continued receipt of the Association’s services after being updated regarding the implementation of the said changes will indicate your consent to these changes and to the updated privacy policy.

Miscellaneous

21. If it is determined in a final and absolute judgment or judicial decision that any part of the privacy policy is invalid, only that part shall be void, and all other parts of the privacy policy shall remain in effect and continue to bind you. You agree that the privacy policy should be given the broadest possible interpretation and application in order to uphold it or any part of it.

22. Only the laws of the State of Israel shall apply to this privacy policy. The exclusive jurisdiction for any matter concerning the privacy policy and the services is in the competent courts in the Tel Aviv-Yafo area.
